Featuring real people in monetized content raises real legal questions — the right of publicity, consent, and privacy. This card gives you the essentials and a sample release you can adapt. The form below is a starting point only, not a finished legal document: have a licensed Texas attorney review and tailor it before you ever rely on it.
Consent Essentials
Informed — the person understands what they’re agreeing to (that you’ll post it, where, and roughly how).
Freely given — no pressure, no coercion, no ’you owe me’ from a bartender they like.
Written is strongest for anyone prominently featured — verbal consent is harder to prove.
Money raises the stakes — monetized, sponsored, or promotional use favors clear written consent.
Minors require extra care — get confirmed parent or guardian permission and venue approval before intentionally featuring one.
Impairment and private spaces — do not rely on consent from someone visibly impaired; get legal guidance for private or intimate content.
When You Really Need a Signed Release

Photo & Video Release In exchange for good and valuable consideration, the receipt of which I acknowledge, I grant __________________ (the “Creator”) and the Creator’s assigns the irrevocable permission to photograph and record me, and to use, reproduce, edit, publish, and distribute my likeness, voice, name, and image in any and all media now known or later developed — including social media, websites, and promotional materials — without further compensation, notice, or approval. I confirm that I am at least 18 years old, that I have read and understood this release, and that I release the Creator from any and all claims arising from the permitted use. |

Using the Release
Get it before or right after filming — not weeks later when the person is gone.
Keep signed releases on file — a clear photo or scan of the signed form is fine to store.
For minors, the parent or guardian signs — never the minor, and never skip it.
For low-stakes, non-monetized clips, a clear written ’yes’ in text or DM can be a lightweight substitute — but use the real form for anything prominent, paid, or branded.
When in doubt, get the signature — it’s far cheaper than a dispute later.
